AT Agency Home Services Website Terms

These AT Agency Home Services Website Terms govern website projects and related managed website services provided through AT Agency Home Services, referred to in these terms as “ATHS.”

ATHS is a service division of AT AGENCY LLC, doing business as AT Agency. ATHS is not a separate legal entity.

These terms supplement the general AT Agency Terms of Service. The client agrees to these terms by placing, electronically accepting, or paying for an Order that incorporates them.

Electronic Acceptance

By checking the required Terms of Service checkbox and completing payment through an AT Agency Stripe checkout, the customer electronically accepts:

The person completing checkout represents that they are at least 18 years old and authorized to accept these terms for the customer or business identified during checkout.

Electronic acceptance and payment are intended to have the same force and effect as a physical signature to the fullest extent permitted by applicable law.

1. Order and Agreement Structure

Order means the applicable Stripe Checkout session, Payment Link, invoice, proposal, statement of work, order form, signed Service Order, or other written or electronic purchase record identifying the customer, selected service, price, payment schedule, scope, or other transaction-specific terms.

An Order may be formed through a Stripe checkout and does not require a separately signed Service Order unless AT Agency specifically requires one for a custom or negotiated engagement.

Each ATHS engagement is governed by:

  1. The applicable Order
  2. These AT Agency Home Services Website Terms
  3. The general AT Agency Terms of Service
  4. Any additional written addendum expressly incorporated into the Order

The applicable Order identifies transaction-specific details such as the customer, selected service, price, deposit, remaining balance, recurring service fee, scope, payment schedule, and any approved written exceptions.

The checkout price, product description, and payment schedule displayed in the applicable Stripe Order are incorporated into the agreement.

The applicable Stripe Order may identify:

  • A $500 website-project deposit
  • The total $1,000 standard website-project price
  • The remaining $500 payment due after completion and client approval and before launch
  • The applicable recurring hosting or website-management plan
  • Any additional services purchased through Stripe

The $1,000 total price applies only when it is displayed in the applicable website-project Order. Other services, add-ons, custom work, or negotiated scopes may have different prices as shown in their applicable Orders.

If documents conflict:

  • The Order controls transaction-specific commercial details and approved exceptions
  • These ATHS Terms control AT Agency Home Services-specific service requirements
  • The general AT Agency Terms of Service control general company-wide matters

A signed Service Order, proposal, or statement of work may still be used for custom pricing, negotiated scopes, additional functionality, custom ownership arrangements, written exceptions, or larger or nonstandard projects, but only when AT Agency specifically requires or accepts one for that engagement.

2. Authority to Accept

The person accepting the Order represents that they are authorized to enter into the agreement for the client or business identified in the Order.

Electronic acceptance, including an electronic signature, checkbox acceptance, payment submission, or another affirmative electronic action, may be used to document the client’s agreement.

3. Complimentary Website Preview

When offered, a complimentary homepage preview is a preliminary sales presentation intended to demonstrate a possible website direction.

The preview may contain placeholder content, temporary images, sample copy, preliminary layouts, mock business information, or other materials that are not intended for publication.

The preview is not a completed website, final deliverable, or guarantee of the exact final appearance.

AT Agency retains ownership of the preview and its underlying materials until the client accepts the Order and pays all required project fees.

Approval of the preview establishes the general visual direction for the website. Requests to materially redesign that direction after approval may be treated as additional work.

4. Standard Website Scope

Unless the Order states otherwise, the standard ATHS website includes:

  • Up to five standard informational pages
  • A mobile-responsive website
  • A homepage based on the approved visual direction
  • Clear presentation of the client’s services and service areas
  • One standard contact or quote-request form
  • Basic contact information and calls to action
  • Connection of one client-owned domain
  • SSL configuration when supported by the hosting platform
  • Basic page titles and meta descriptions
  • Basic launch configuration
  • Contact-form testing before launch

Page selection may include a homepage, services page, about page, service-area page, gallery page, contact page, or another standard informational page approved in the Order.

AT Agency may structure or combine page content in the manner it considers most appropriate for usability, clarity, and performance.

5. Services Not Included

Unless expressly included in the Order, the standard website does not include:

  • Ecommerce or online store functionality
  • Custom software or application development
  • Customer portals, memberships, or account systems
  • Advanced booking, scheduling, or estimating systems
  • Custom databases
  • Complex calculators or interactive tools
  • Advanced third-party integrations
  • Professional copywriting
  • Logo or brand identity development
  • Custom photography or video production
  • Paid stock assets
  • Legal, accounting, tax, or regulatory advice
  • Accessibility certification or legal compliance certification
  • Guaranteed search-engine rankings
  • Ongoing advertising, social media, or lead-generation services
  • Business email setup or email hosting
  • Unlimited revisions
  • Editable design files, development source files, or unused concepts
  • Website migration or transfer after cancellation
  • Services not expressly described in the Order

Excluded services may be added through a separate written estimate or change authorization.

6. Client Content and Responsibilities

The client is responsible for providing complete and accurate materials reasonably required for the project, including:

  • Business name and contact information
  • Service descriptions
  • Service-area information
  • Logo and brand materials
  • Photographs and videos
  • Required legal or professional disclosures
  • Domain and platform access
  • Feedback, corrections, and approvals
  • Any licenses, permissions, or authorizations required for supplied content

The client represents that it owns or has permission to use all materials supplied to AT Agency.

The client is responsible for the factual accuracy, legality, safety, and regulatory compliance of its services, claims, testimonials, licenses, certifications, prices, warranties, and website content.

AT Agency may rely on information provided by the client and is not responsible for independently verifying that information.

7. Project Start and Timeline

Production begins after AT Agency has received:

  1. An accepted Order
  2. The required initial payment
  3. Complete website content and materials
  4. Required account, domain, or platform access
  5. Any other information reasonably required to begin

The standard target turnaround is approximately five to seven business days after all required items have been received.

This timeframe is an estimate and not a guaranteed completion date.

The schedule may be extended because of client delays, incomplete materials, scope changes, third-party platform issues, technical complications, holidays, emergencies, or circumstances outside AT Agency’s reasonable control.

8. Payments

The applicable Order states the project fee, initial payment, final payment, recurring fee, and payment schedule.

The initial project payment reserves production capacity and authorizes AT Agency to begin work. Once production begins, the initial payment is nonrefundable except when required by law or expressly agreed in writing.

The remaining project balance is due after completion and client approval and before the website is connected to the live domain or publicly launched.

AT Agency is not required to transfer, launch, publish, or release final website materials until all required project payments have cleared.

Recurring managed website fees are billed separately according to the applicable Order.

Payments are processed through Stripe or another payment method approved by AT Agency.

9. Included Corrections

The standard website includes one consolidated correction round before final approval.

The client must submit the included corrections together in one organized written list.

The correction round is intended for reasonable items such as:

  • Factual corrections
  • Contact-information corrections
  • Minor text replacements
  • Reasonable client-provided image replacements
  • Correction of errors or omissions
  • Minor adjustments that remain consistent with the approved direction

The included correction round does not include a new design direction, complete restructuring, additional pages, major copy changes, new functionality, or repeated rounds of individual changes.

Additional revisions or work outside the agreed scope require written approval and may be billed at $150 per hour or quoted as a separate fixed fee.

10. Approval and Completion

The client is responsible for reviewing the website carefully before approval.

Approval may be provided by email, written message, electronic acceptance, or another written method accepted by AT Agency.

Once the client approves the completed website:

  • The project is considered complete
  • The final project payment becomes due
  • Further changes may be billed separately
  • AT Agency may prepare the website for launch

If the client does not respond, the project will be paused until feedback or approval is received. Client delays may extend the launch date.

11. Website Launch

Launch occurs after:

  • The website is completed
  • The client provides final approval
  • All required project payments have cleared
  • Required domain and platform access has been provided
  • The applicable Managed Website service is active
  • Any remaining launch requirements have been completed

AT Agency may delay launch when payment, approval, content, access, or another required item remains outstanding.

12. Managed Website Service

Unless the Order states otherwise, the ATHS website is hosted and maintained through the AT Agency Managed Website service beginning at launch.

The Managed Website service includes:

  • AT Agency-managed website hosting
  • SSL and domain connection support
  • Routine platform maintenance
  • Uptime monitoring
  • Contact-form testing
  • Priority support
  • A response target of one to two business days
  • One small website content update each month, up to 30 minutes

The monthly update allowance:

  • Is limited to 30 minutes of AT Agency production time
  • Does not roll over between billing periods
  • Cannot be transferred or accumulated
  • Does not include redesign, development, new pages, advanced integrations, copywriting, ecommerce work, or other substantial work

The Managed Website service does not include monthly reporting.

Additional work requires written approval and may be billed at $150 per hour or quoted separately.

Response targets are goals and do not guarantee that every request will be completed within the stated period. Resolution time depends on scope, complexity, access, and third-party services.

13. Recurring Billing and Cancellation

The amount and billing frequency for recurring services are displayed in the applicable Stripe Order.

The Managed Website service is billed monthly in advance using the payment method provided by the client.

The subscription renews automatically each month until canceled.

What the selected plan includes is governed by the product description in the applicable Order and these ATHS Terms.

Work outside the included plan is billed separately with client approval.

The client may cancel the Managed Website service by:

  • Using an available online customer billing portal, or
  • Emailing a cancellation request to info@at.agency

Cancellation becomes effective at the end of the current paid billing period unless AT Agency confirms a different date in writing.

Monthly fees already charged are not prorated or refunded except when required by law.

When cancellation becomes effective, AT Agency’s hosting, monitoring, maintenance, updates, support, forms, integrations, or public access to the website may end, and the website may be taken offline at the conclusion of the paid service period.

If payment fails or remains past due, AT Agency may suspend website hosting, maintenance, updates, support, forms, integrations, or public access to the website after reasonable notice.

14. Effect of Managed Service Cancellation

The website is hosted and maintained on AT Agency-managed infrastructure while the Managed Website service remains active.

When the Managed Website service ends:

  • AT Agency’s hosting, monitoring, maintenance, updates, and support end
  • The website may be taken offline at the conclusion of the paid service period
  • AT Agency is not required to continue hosting the website without an active service
  • Third-party subscriptions or functionality managed through AT Agency may end
  • Domain ownership remains with the client if the domain is registered to the client

The client may request a website transfer or migration before cancellation becomes effective.

Transfers and migrations are subject to:

  • Platform capabilities and restrictions
  • Payment of all outstanding balances
  • A separate migration estimate
  • Third-party platform fees
  • Technical limitations
  • Cooperation from the client and receiving provider

AT Agency does not guarantee that every feature, design element, integration, animation, or function can be transferred to another platform.

15. Domains and Third-Party Services

The client should purchase and maintain ownership of its domain name.

The client is responsible for domain registration fees, renewal fees, account security, and maintaining accurate domain-account information.

AT Agency may assist with connecting the client’s domain but is not responsible for domain expiration, registrar outages, client account lockouts, ownership disputes, or failures caused by the domain provider.

The website may rely on third-party services, platforms, plugins, applications, hosting providers, form providers, analytics services, fonts, stock assets, or integrations.

Third-party services are governed by their own terms, policies, pricing, and availability. AT Agency is not responsible for third-party outages, policy changes, price changes, security incidents, service limitations, or discontinuation.

16. Website Ownership

After all project fees have been paid, the client owns:

  • Client-provided materials
  • Client-specific approved website copy
  • Client-specific final visual content created exclusively for the project, subject to any third-party licenses

AT Agency retains ownership of:

  • Preexisting intellectual property
  • Reusable layouts and components
  • Development methods and processes
  • Internal systems and templates
  • Software tools
  • Working files
  • Source materials
  • Unused concepts
  • General knowledge and techniques
  • Materials licensed from third parties

The client receives the right to use the completed website for its business while complying with applicable third-party and platform terms.

Editable files, source files, working files, and internal production materials are not included unless expressly stated in the Order.

17. Project Cancellation and Inactivity

If the client cancels after production begins, amounts already paid remain nonrefundable except when required by law.

The client remains responsible for approved work completed, noncancelable third-party costs, and other amounts due under the Order.

If the client does not provide required content, access, feedback, or approval for 30 consecutive days, AT Agency may place the project on inactive status.

Restarting an inactive project is subject to AT Agency’s availability and may require a revised schedule or restart fee.

If inactivity continues for 60 consecutive days, AT Agency may close the project. Closing an inactive project does not require AT Agency to refund amounts previously paid.

18. Performance and Availability

AT Agency does not guarantee specific sales, leads, revenue, conversion rates, search-engine rankings, traffic, customer inquiries, or other business results.

Uptime monitoring does not guarantee uninterrupted website availability.

Contact-form testing confirms basic functionality at the time of testing but does not guarantee continuous email delivery or performance of third-party email providers, spam filters, hosting platforms, or integrations.

AT Agency may perform maintenance, updates, security work, or service changes when reasonably necessary.

19. Legal and Regulatory Responsibility

The client is responsible for determining which laws, regulations, licensing rules, professional requirements, accessibility requirements, privacy disclosures, cookie notices, industry rules, and consumer disclosures apply to its business and website.

AT Agency does not provide legal, accounting, tax, licensing, accessibility, or regulatory advice.

The client should obtain advice from qualified professionals when needed.

20. Portfolio Use

Unless prohibited by the Order, a confidentiality agreement, or a written request received before launch, AT Agency may identify the client and display the publicly released website, business name, and logo in its portfolio, website, presentations, sales materials, social media, and award submissions.

AT Agency will not knowingly disclose confidential client information through such use.

21. General Terms

The general AT Agency Terms of Service are incorporated into these ATHS terms and govern matters not specifically addressed here, including confidentiality, limitations of liability, third-party services, governing law, disputes, and general website use.

The AT Agency Privacy Policy explains how AT Agency handles information collected through its website and services.

22. Updates to These Terms

AT Agency may update these terms for future Orders.

The version incorporated into an accepted Order continues to govern that engagement unless the client and AT Agency agree to an updated version in writing.

Each version of these terms should display its effective date and version number.
